Terms of Use
The rules for using Home Forecast, our quoting and scheduling tools, and our SMS program. Plain English where we can manage it.
The short version
In plain English
- Use the site to learn about our services, get a quote, book a job, or pay an invoice.
- Be honest with the info you give us. Don’t try to break, scrape, or abuse the site.
- Quotes shown online are estimates until a technician inspects the work. The written quote you sign is the binding one.
- If you opt in to texts, follow the SMS rules in our Privacy Policy. Reply
STOPto opt out. - Disputes that can’t be worked out informally go to arbitration on an individual basis (see Section 12).
Your agreement with us
These Terms of Use (“Terms”) are a contract between you and Home Forecast (“Home Forecast,” “we,” “us”). By using the site, submitting a form, or messaging us, you agree to these Terms. If you don’t agree, please don’t use the site.
Who can use the site
You must be at least 18 years old (or the age of majority in your state) to submit a service request or accept a quote. You must own the property you’re asking us to service, or have permission from the owner.
Information you give us
When you fill out the qualifier or contact form, you agree the information you provide is accurate, current, and yours to share. If something changes (your phone number, your address), let us know so we can keep helping you.
If we issue you a customer-portal login at any point, you’re responsible for keeping your credentials private and for activity on your account.
Quotes, scheduling, and services
- Online quotes are estimates. Final pricing is set after on-site inspection and presented to you in writing before any work begins. You can decline at no cost (subject to a diagnostic fee on repair calls, which is disclosed up front).
- Scheduling windows are estimates. Weather, prior jobs, and emergencies can shift things. We’ll keep you posted by text or call.
- Permits, inspections, and code compliance. We pull required permits and follow local code. If conditions in the home (asbestos, illegal modifications, structural issues) prevent us from completing the job safely, we’ll stop and explain.
- Workmanship warranty. Our installation work is warrantied as stated on your invoice. Manufacturer warranties on equipment are governed by the manufacturer.
- Payment. Invoices are due as stated on the invoice. Past-due balances may incur late fees and reasonable collection costs as permitted by law.
Text messaging
If you provide your phone number and check the SMS consent box (or text us first), you agree to receive text messages from Home Forecast about your service request and, if you opt in separately, occasional marketing messages. Message and data rates may apply. Reply STOP to opt out, or HELP for help.
Full details, including frequency, supported carriers, and our promise not to share your number with third parties for marketing, are in our Privacy Policy. Consent is not a condition of purchase.
Acceptable use
We work hard to keep the site fast and useful. Please don’t:
- Submit false, misleading, or fraudulent information.
- Use the qualifier to test, spam, or harass us.
- Scrape, copy, or republish our content without written permission.
- Reverse-engineer, probe, or attempt to bypass any security measures.
- Upload anything unlawful, infringing, malicious, or that contains personally identifying information about anyone other than yourself or your household.
- Use any automated tool to send messages, create accounts, or place fake bookings.
We may suspend, block, or remove access if you do, and we may report serious abuse to authorities.
Our content
The site, its design, copy, code, photos, and our logo and brand are owned by Home Forecast (or our licensors) and are protected by intellectual-property laws. You can view and share pages for your personal, non-commercial use. Everything else needs our written permission first.
Photos and notes you upload
When you upload a photo of your equipment or describe your issue, you grant us a non-exclusive, worldwide, royalty-free license to use that content to provide the service you asked for, train our team internally, and improve our diagnostic process. We will not publish your photos or quotes externally without your permission.
Third-party links and services
We may link to manufacturers, financing partners, or rebate programs. Those sites have their own terms and privacy policies. We’re not responsible for what they do.
Disclaimers
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE. THIS DOES NOT AFFECT THE WORKMANSHIP WARRANTY ON ANY PHYSICAL WORK WE PERFORM AT YOUR PROPERTY, WHICH IS GOVERNED BY YOUR INVOICE.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, HOME FORECAST AND OUR OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE IS LIMITED TO ONE HUNDRED U.S. DOLLARS ($100). NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW (FOR EXAMPLE, FRAUD OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE).
Disputes and arbitration
We want to fix problems quickly and informally. If you have a complaint, email hello@homeforecast.ca first and we’ll try to make it right within 30 days.
Arbitration & class waiver
If we can’t resolve a dispute informally, you and Home Forecast agree to settle it through binding individual arbitration under the rules of the American Arbitration Association, in the county where the property is located. You waive the right to bring or participate in a class action against us. Either party may still bring a small-claims case in the proper court for claims that qualify, and either party may seek injunctive relief in court for intellectual-property or unauthorized-access matters.
You may opt out of this arbitration agreement by emailing hello@homeforecast.ca within 30 days of first using the site, with the subject line “Arbitration Opt-Out.”
Suspending access
We may suspend or terminate your access to the site at any time if you violate these Terms. Sections that by their nature should survive (intellectual property, disclaimers, limitation of liability, disputes) will continue to apply.
Governing law
These Terms are governed by the laws of the state where Home Forecast is organized, without regard to conflict-of-laws rules. Subject to the arbitration section above, the state and federal courts located in that state have exclusive jurisdiction.
Changes to these terms
We may update these Terms when our practices or the law change. The “effective” date at the top tells you when we last did. Material changes will be announced on this page or via email. Your continued use of the site after changes means you accept them.
